Terms of Service

These Terms of Service govern your use of apexarchitects.xyz, the Apex Radar competitive intelligence service, and the Apex Intelligence Slack application, all operated by Apex Architects ('we', 'us', 'our'). By using any of these services, you agree to these terms.

If you are using our services on behalf of a company, you represent that you have the authority to bind that company to these terms.

Website Creation. We design and build websites on the Internet Computer Protocol blockchain. Delivery timelines are estimates. The rebuild guarantee applies after the first revision round as described in your project brief. Upon final delivery, you own the canister and all code outright.

AEO Optimization. AEO retainers are month-to-month after the 3-month minimum. We do not guarantee specific citation outcomes, as AI engine behavior is outside our control. We guarantee our work will be performed as described and will include monthly citation monitoring as proof.

Apex Radar. Reports are delivered within 48 hours. The no-results guarantee means: if we cannot surface actionable intelligence from public sources about your configured competitors, you pay nothing for that report. We do not guarantee the accuracy of data scraped from public websites, as that data changes.

Apex Intelligence Slack app. We provide the app on an as-is basis. We reserve the right to modify features, adjust plan limits, or discontinue the app with reasonable notice.

All prices are in USD unless otherwise agreed. For website projects, payment is 50% upfront and 50% on delivery. For monthly retainers and subscriptions, payment is monthly via Stripe.

Refunds are not issued for completed website deliveries after the final revision round. For monthly services, you may cancel at any time and will not be billed for the following month. No partial-month refunds.

If a payment fails, we will attempt to notify you and may suspend service until payment is resolved.

You agree not to use our services to: violate any applicable law; infringe on the intellectual property of others; scan websites you do not have permission to analyze; distribute, resell, or sublicense our reports without written permission; attempt to reverse-engineer or scrape our platform.

We may suspend or terminate your access if we have reason to believe these terms have been violated.

Website projects. Upon full payment, you own the delivered website code, design assets, and ICP canister. Apex Architects retains the right to display the work in our portfolio unless you request otherwise in writing.

Reports and analysis. Apex Radar and Apex Intelligence reports are licensed to you for internal business use. You may share individual reports within your organization. You may not resell or publicly distribute report content.

Platform. The Apex Architects website, software, and brand are owned by Apex Architects. Nothing in these terms transfers ownership of our platform to you.

Apex Radar collects data from publicly accessible websites. We are not responsible for the accuracy, completeness, or legality of third-party content. Competitor pricing, copy, and positioning data reflects what was publicly available at the time of the scan.

To the maximum extent permitted by law, Apex Architects is not liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim is limited to the amount you paid us in the 30 days preceding the claim.

We are not liable for outcomes related to AI engine citation behavior, competitor responses, or business decisions made based on our reports.

These terms are governed by the laws of the Province of Quebec and the federal laws of Canada applicable in Quebec. Any disputes will be resolved in the courts of Montreal, Quebec.

We may update these terms. Material changes will be posted to this page with a new 'Last updated' date. Continued use of our services after a change constitutes acceptance.
